Terms and Conditions for Active 24hr Fitness

 

1. Membership Agreement By becoming a member of Active 24hr fitness, you agree to the following terms and conditions.

 

2. Access Hours: the gym is open 24 hours a day, 7 days a week, for members with active access. Non-members are not permitted to access the gym facilities. if you bring a non-member to the club, you acknowledge that:

You accept responsibility and liability on the non-member's behalf for any injury, loss or damage to the non-member regardless of negligence of the club. You will immediately have your membership cancelled and will not be permitted to join the club again as well as $500 fine being charged to your nominated account.

 

3. Membership Fees: membership fees are due at the time of sign-up and are recurring fortnightly/monthly/yearly. All fees are non-refundable, except where required by law. Club reserves the right to cancel the membership effective immediately if any terms laid out on the club usage and guidelines are broken.

Also, I agree that there may be delay in processing direct debit if:

 

a) There is a public or bank holiday on day of direct debit or any day after the debit date.

​

b) A payment request is received by the club on a day that is not a banking business day in QLD, NSW, SA or VIC.

​

4. Membership Freeze: You may freeze your membership for a minimum of 2 weeks and maximum of 8 weeks in one year provided that you are up to date with all previous payments. Any paid in full members are entitled to freeze the membership up to maximum of 8 weeks in 1 year. Less than 1 year paid in full memberships can freeze up to 2 weeks per account.

5. Rejection Fees: A $10 administration fee applies if a fortnightly payment is rejected by your nominated financial institution.

 

6. Age Restrictions: Members 16 yr and over but under 18 will be granted 24hr access if a parent/guardian signs to allow them to do so. Members 14-16 yr old will be allowed to use the facility during the staffed hours if they fill out the pre- exercise questionnaire and a parent/guardian sign to allow them to use the facility.

 

7. Use of Facilities: Members agree to use gym equipment and facilities responsibly and in accordance with any posted rules or staff instructions.

 

8. Code of Conduct: Members must act respectfully towards others, avoiding disruptive or inappropriate behavior. Members must clean equipment after use and follow hygiene protocols. No abusive language or behavior will be tolerated. Violations may result in immediate membership termination.

9. Fee increase: Club reserves the right to increase the fees at any time providing the club gives 30 days email notice to members on their nominated email address provided to us.

​

10. 48hr Cooling-off period: applies with the Pay in full and direct debit memberships. you must inform the club in writing within the 48 hours of signing the membership agreement to be entitled to a full refund.

​

11. Cancellation: 

Pay in full: are non-refundable and non-transferrable to another club.

​

No contract direct debit: memberships can be cancelled at any time by providing the club with a signed letter or by cancelling in person at the club. Cancellation must be atleast 2 days before the next direct debit to allow time to cancel your membership. your card must be returned to complete the cancellation process. cancellation is only completed providing you are up to date with your all-previous payments.

​

12-month direct debit: contract cannot be cancelled after the 48hr cooling off period and you are liable to pay the entire amount agreed upon as per your contract.

12. Transfer: Pay in full memberships can be transferred to a non-member for an admin fee of $40.

​

Direct debit memberships can be transferred to non-members for a fee of $40.

​

 

13. Health and Safety: members must ensure they are in suitable health to participate in physical exercise. It is recommended to consult a doctor before beginning any exercise program.The gym is not liable for injuries sustained due to improper use of equipment or failure to follow safety instructions.

 

14. Access Control & Security: members will be provided with an access card or key fob for 24-hour access. The card is non-transferable. Lost or stolen access cards must be reported immediately. A replacement fee may apply. Members are responsible for securing their personal belongings. The gym is not responsible for lost or stolen items.

 

15. Guest Policy: guests are not permitted without prior approval from gym management. Some locations may offer guest passes for a limited time.

 

16. Suspension and Termination. the gym reserves the right to suspend or terminate a membership in the event of a breach of these terms and conditions, including non-payment of fees or inappropriate behavior.

 

17. Privacy and Data Protection: personal information collected will be handled in accordance with our privacy policy. We respect the privacy of our members and are committed to protecting their data.

 

18. Modifications to Terms: the gym reserves the right to modify these terms and conditions at any time. Members will be notified of any significant changes.

 

19. Liability Waiver: By joining Active 24hr fitness, you acknowledge that the gym is not responsible for any personal injury, loss, or damage to property while using the gym's facilities.

20. Video Surveillance: For member and staff safety we have video surveillance covering all areas of the gym excluding toilets and/or showers, by signing this contract you acknowledge that you will be recorded upon entering the club.

​

21. Personal training: All members are provided with a complimentary training session whereby a qualified trainer can show you how to use the equipment in safe and proper manner. 

​

22. Personal information: it is your responsibility to inform the club of any changes to your personal details that are relevant to your membership.

​

 

23. Release and Indemnity:

 

I certify, acknowledge and understand by signing this that the use of gym equipment and participation in physical exercise carries inherent risks of injury, including, but not limited to, sprains, fractures, cuts, bruises, and in extreme cases, even death. I voluntarily assume all risks associated with my participation in any activities or use of any facilities provided by Active 24hr fitness, including but not limited to exercise equipment, classes, and group training sessions.

I hereby release, waive, discharge, and covenant not to sue Active 24hr fitness, its owners, directors, officers, employees, agents, or representatives, from any and all liability for any injury, damage, loss, or expense (including, without limitation, legal fees) that I may sustain, arising out of or in any way related to my participation in gym activities or use of gym facilities, regardless of the cause, including any negligent act or omission by Active 24hr fitness.

I agree to indemnify, defend, and hold harmless Active 24hr fitness and its affiliates, officers, employees, agents, and contractors from any claims, damages, losses, costs, or expenses, including reasonable attorneys' fees, arising out of or in connection with my use of the gym facilities and participation in its activities. This includes, but is not limited to, any claims made by third parties due to my actions while using the gym.

I represent that I am in good physical condition and do not have any medical conditions that would prevent me from safely using the gym's facilities or participating in exercise activities. I understand that it is advisable to consult with a physician before starting any fitness program. I agree to notify the gym immediately of any health concerns or injuries that could affect my participation in gym activities.

​

I agree to follow all gym rules and regulations, including safety instructions provided by the gym staff. Failure to comply with these rules may result in the suspension or termination of my membership without a refund.

​

I understand that Active 24hr fitness is not responsible for the loss, theft, or damage to any personal belongings, including clothing, equipment, or accessories, while using the gym facilities.

​

I consent to the use of any photographs, video recordings, or other media that may include my likeness, taken while I am using the gym facilities, for promotional or marketing purposes by Active 24hr fitness, without compensation.

​

If any provision of this Agreement is held to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

​

I have read and fully understand the contents of this Release of Indemnity Agreement. I am aware that by signing/reading this Agreement, I am waiving certain legal rights, including the right to sue. I voluntarily accept the terms and conditions set forth herein.
